How can we solve the paradox of false-belief understanding: if infants pass the implicit false belief task by nonverbal behavioural responses why do they nonetheless typically fail the explicit FBT till they are 4 years old? Starting with the divide between situational and cognitive accounts of the development of false-belief understanding, we argue that we need to consider both situational and internal cognitive factors together and describe their interaction to adequately explain the development of children’s Theory of Mind ability. We (...) then argue that a further challenge is raised for existing accounts by helping behaviour versions of the FBT. We argue that the common two-stage accounts are inadequate: we need to allow for three central stages in a continuous development. Furthermore, drawing on Perner et al.’s and Perner and Leahy’s : 491–508, 2016) recent mental files account, we provide a new account of the development of these three stages of ToM ability by describing the changes of the structure and organisation of mental files including the systematic triggering role of types of situations. Thereby we aim to establish a situational mental file account as a new and adequate solution to the paradox of false-belief understanding. (shrink)

This essay asks if there is a role for an active public in ratcheting down the harsh politics of crime control in the United States and the United Kingdom that has led to increased use of the criminal law and greater severity in punishment. It considers two opposing answers offered by political and legal theorists and then begins to develop a participatory democratic framework for institutional reform.

This essay discusses the jury 's value in American democracy by examining Alexis de Tocqueville 's analysis of the jury as a free school for the public. His account of jury socialization, which stressed lay deference to judges and trust in professional knowledge, was one side of a complex set of ideas about trust and authority in American political thought. Tocqueville 's contemporary Francis Lieber held juries to have important competencies and to be ambivalent rather than deferential regarding court professionals. (...) The nineteenth-century courtroom exhibited such ambivalence and was marked by institutional conflict involving increasing professional authority demanded by the bench and populist counter-pressures. Assessing the value of the jury today may require some of the conceptual tools Tocqueville offers, but must also renew an appreciation of the jury as a site that utilizes already existing juridical capabilities of lay people and thus re-conceive the relationship between lay people and court professionals. Stronach and Allan state that the use of humor by the disabled is an attempt to reintegrate themselves back into a social surround. Seeing this assignment of a reintegration function as a bit too teleological, and given the absence of interactional data, the reviewer is critical of the authors' reliance on literary research and offers an alternative way to study humor in interaction.

Other authors reject the e xistence of on l y one co r rect an sw er or the possibility of f inding it. N e v er theless, e v en accepting that there are some aspects of discretiona r y decisions that do not der i ve from l e gal no r ms bu t from personal preferences, those preferences must be coherent with some theo r y that contains no r mat i v e l y co r rect criteria. The sharing of research data is now mandated by some funders to encourage openness and integrity in science, to ensure efficient use of research funds, and to provide training resources. Although data sharing has a long history in some parts of science, the full range of possibilities and challenges it offers are only now becoming apparent in the social sciences. This article (a) examines what may be entailed in sharing documented data, (b) provides a historical perspective on data sharing, (c) (...) describes some of the creative and successful data-sharing relationships that have occurred in the social sciences, and (d) discusses some of the main concerns of social scientists with respect to sharing their data and how these concerns might be resolved. The central result of this paper is the small‐is‐very‐small principle for restricted sequential theories. The principle says roughly that whenever the given theory shows that a definable property has a small witness, i.e., a witness in a sufficiently small definable cut, then it shows that the property has a very small witness: i.e., a witness below a given standard number. Which cuts are sufficiently small will depend on the complexity of the formula defining the property. We draw various consequences from (...) the central result. E.g., roughly speaking, (i) every restricted, recursively enumerable sequential theory has a finitely axiomatized extension that is conservative with respect to formulas of complexity ; (ii) every sequential model has, for any n, an extension that is elementary for formulas of complexity, in which the intersection of all definable cuts is the natural numbers; (iii) we have reflection for ‐sentences with sufficiently small witness in any consistent restricted theory U; (iv) suppose U is recursively enumerable and sequential. Suppose further that every recursively enumerable and sequential V that locally inteprets U, globally interprets U. Then, U is mutually globally interpretable with a finitely axiomatized sequential theory. The paper contains some careful groundwork developing partial satisfaction predicates in sequential theories for the complexity measure depth of quantifier alternations. (shrink)

This paper compares the ethical standards reported by consumers and managers with different attachment styles (secure, preoccupied, fearful, or dismissing). We conducted two studies of consumer ethical beliefs and a third managerial survey. In Study 1, we used a questionnaire that we constructed, and in Study 2, we used the Muncy–Vitell Consumer Ethics Scale. The results in both the studies were consistent and showed that men reported a greater indifference to ethical transgressions than women. Based on the two studies, the (...) results indicate that␣among male consumers, the dismissing participants reported the greatest overall indifference to ethical transgressions and the secure participants expressed the most ethical beliefs. The two intermediate groups did not differ significantly from each other. In Study 1, none of the women consumers reported a dismissing attachment style. Women with a secure style reported more ethical beliefs than those in the other two groups. However, the sample in Study 2 included dismissing women. The dismissing women reported the greatest overall indifference to ethical transgressions and the secure women expressed the most ethical beliefs. The illegal profit subscale described the most severe ethical transgressions, and for both men and women, the secure participants were less apt than the other participants to report a willingness to transgress. In Study 3, the Newstrom and Ruch (1975, MSU Business Topics, Winter, 31) Questionnaire was administered to 227 managers. All four attachment patterns were represented among the participants of both genders. In all cases, the participants with a dismissing attachment style showed the greatest readiness to transgress. Clinical trials are a central mechanism in the production of medical knowledge. They are the gold standard by which such knowledge is evaluated. They are widespread both in the United States and internationally; a National Institute of Health database reports over 106,000 active industry and government-sponsored trials (National Institutes of Health n.d.). They are an engine of the economy. The work of trials is complex; multiple people with diverse interests working across multiple settings simultaneously participate in them, and they are (...) underwritten by multiple organizational structures and diverse funding mechanisms. Why is the average quality of research in open science so high? The answer seems obvious. Science is highly competitive, and publishing high quality research is the way to rise to the top. Thus, researchers face strong incentives to produce high quality work. However, this is only part of the answer. High quality in science, after all, is what researchers in the relevant field consider to be high quality. Why and how do competing researchers coordinate on common quality standards? The theology of John Calvin has deeply affected the American mentality through two streams of thought, Puritanism and Jansenism. These traditions formulate moral problems in terms of absolute, clear principles and avoid casuistic analysis of moral problems. This approach is designated American moralism. This article suggests that the bioethics movement in the United States was stimulated by the moralistic mentality but that the work of the bioethics has departed from this viewpoint.
